What is an Emphyteutic Lease?
An emphyteutic lease is a very long-term real estate lease agreement concluded between two parties for a minimum duration of 18 years and a maximum of 99 years. It allows the separation of property rights between the tenant (called emphyteuta) and the landlord (called trefranc).
The tenant enjoys significantly more extensive rights than with a traditional lease, almost equivalent to ownership rights (called "real rights"). However, the tenant also assumes specific obligations related to the emphyteutic lease.
The tenant may undertake modifications or improvements to the property and has the right to mortgage or sublet it. The tenant pays an annual fee (called an emphyteutic rent or "canon"), which is often symbolic. However, the tenant is responsible for all property charges and major repairs. The tenant must not damage the property and is responsible for paying property tax as an owner would.
Upon expiration of the contract, the landlord recovers full ownership of the property, including any improvements made by the tenant during the lease period. The landlord may seek judicial termination of the lease if the tenant breaches contractual conditions or causes serious property damage.
Tacit renewal is not possible. A new agreement must be explicitly signed by both parties.
